Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the website at urvilperformance.com and any service offered through it (collectively, the "Services") operated by Urvil Performance LLC ("we", "us"). By using the Services, you agree to these Terms.

1. Who can use the Services

You must be at least 13 years old to use this site. If you are under 18, you may only purchase a program or submit a liability waiver with the involvement and written consent of a parent or legal guardian.

2. Nature of the Services

The Services consist of online strength-and-conditioning programs designed for volleyball athletes, delivered through the TrainHeroic application. Urvil Patel is a NSCA Certified Strength and Conditioning Specialist (CSCS) and a Doctor of Physical Therapy student. The Services are coaching and training services, not medical care, diagnosis, treatment, physical therapy, or a substitute for advice from a licensed healthcare provider. Consult your physician before beginning any new exercise program.

3. Subscriptions and billing

Our blueprint programs are sold as recurring subscriptions billed every four (4) weeks through Stripe. By starting a subscription you authorize us to charge your payment method on each billing date until the subscription ends.

  • Term cap. Each subscription is configured to automatically stop after six (6) billing cycles, matching the 6-month design of the program.
  • Self-service. You may cancel your subscription at any time at /account. Cancellation takes effect at the end of your current billing period.
  • Refunds. Subscription fees are generally non-refundable except where required by law. As an exception, if you have completed two (2) full training blocks, can demonstrate that you completed the assigned workouts (e.g. via TrainHeroic completion history), and are not seeing progress, you may request a refund by contacting us at urvilperformance@gmail.com. Refund requests are evaluated case by case. If you experience a billing error, contact us within 30 days and we will work with you in good faith.
  • Failed payments. If a payment fails, Stripe will retry automatically. We may suspend your access if payment is not completed within a reasonable retry window.

4. Liability waiver

Before participating in any program, you must complete the liability waiver at /liability. Athletes under 18 also require a parent or legal guardian signature. The waiver is a binding part of these Terms.

5. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose
  • Reverse engineer, scrape, or attempt to gain unauthorized access to any part of the Services or their infrastructure
  • Resell, redistribute, or republish program content without our written permission
  • Impersonate any other person, including by submitting a waiver on someone else's behalf without authorization
  • Submit information you know to be false

6. Intellectual property

All content on the site and in the programs, including workout designs, video instruction, exercise progressions, written guidance, branding, and the site design itself, is owned by Urvil Performance LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the program content for your own personal training use during your active subscription. No other rights are granted.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

RESULTS FROM A STRENGTH AND CONDITIONING PROGRAM VARY BY INDIVIDUAL. WE DO NOT GUARANTEE ANY SPECIFIC OUTCOME, INCREASE IN VERTICAL JUMP, OR ATHLETIC PERFORMANCE IMPROVEMENT.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
  • OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED DOLLARS ($100).

These limitations apply to claims against Urvil Performance LLC, Urvil Patel, their affiliates, and the technical contractors and service providers acting on their behalf (including Signal X Studio LLC).

9. Indemnification

You agree to indemnify, defend, and hold harmless Urvil Performance LLC, Urvil Patel, their affiliates, and their technical contractors and service providers (including Signal X Studio LLC) from any claim arising out of (a) your use of the Services in violation of these Terms, (b) your violation of any law, or (c) information you provided to us that turned out to be false or misleading.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. You may stop using the Services at any time by cancelling your subscription. Sections that by their nature should survive termination (including Sections 6 through 11 and 13) will survive.

11. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services must be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction in those courts.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with an updated "Last updated" date. Continued use of the Services after a change constitutes acceptance.

13. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy and Liability Waiver, are the entire agreement between you and us regarding the Services.
